Federal Lawsuit to Assure Constitutional Rights of Students and Parents in Public Schools

APRIL 2011 - Alvarez Garcia recently filed a federal lawsuit to assure the constitutional rights of parents and students when subjected to involuntary counseling in Hillsborough County public schools. The suit arose from a school-social worker's counseling of a thirteen-year old student who, for the first time, disclosed her suicidal intentions. The social worker released the student after the critical disclosure and without notifying the parents of their daughter's interests and need for care. The youngster committed suicide on the very next day. The importance of the subject matter and suit has since garnered considerable interest in the public media:

Open Challenge to All Professional Colleagues

logo.jpg

Rick and Anthony extend an open challege to all colleagues to donate any available time or funds to the charity, Voices for Children for Hillsborough County. Every year in Hillsborough County, thousands of children are trapped in domestic situations rife with hopelessness. Even after the children are rescued by law enforcement, the great majority of them have no control over their futures and little chance of success before the courts. Voices for Children works tirelessly on behalf of such children to appoint interested and able guardians ad litem who will speak loudly for them when given the opportunity.

As explained at the website, www.vfcgal.org, there are various ways that attorneys in the Tampa Bay Area can provide assistance. First, they can contribute funds that will facilitate the appointment of guardians. Currently, the program can serve only about thirty-five percent of these children. Second, attorneys and members of their staffs can utilize their personal time to volunteer as guardians.

Alvarez Garcia has contributed to Voices for Children by assigning the fees ordinarily paid in the firm's service as guardians ad litem in matters before the civil courts. Rick and Anthony, once again, challenge their colleagues in the Tampa Bay Area to do the same.
